These Terms and Conditions ("Terms") govern your purchase and use of AdvanceLMS, a Learning Management System software product. By purchasing AdvanceLMS, you agree to be bound by these Terms.
Please read these Terms carefully. If you do not agree with any part of these Terms, you should not purchase or use AdvanceLMS.
1. Definitions
- "Software" refers to AdvanceLMS, including all source code, documentation, and related materials.
- "You" or "Customer" refers to the individual or organization purchasing the Software.
- "We", "Us", or "AdvanceLMS" refers to the provider of the Software.
- "Source Code" refers to the complete, unobfuscated code files of the Software.
2. License Grant
2.1 What You Get:
Upon payment of ₹20,000, you receive:
- Complete source code of AdvanceLMS
- Full documentation
- Installation support
- Lifetime updates to the Software
- Technical support via WhatsApp and email
2.2 What You Can Do:
- Install the Software on your own server(s)
- Customize and modify the source code for your own use
- Use the Software for your educational institute
- Create derivative works for your internal use
- Use the Software for a single institute or organization
2.3 What You Cannot Do:
- Resell, redistribute, or sublicense the Software to third parties
- Offer the Software as a service (SaaS) to other institutes
- Claim ownership or authorship of the original Software
- Remove or alter any copyright notices in the source code
- Reverse engineer any compiled or obfuscated portions (if applicable)
3. Payment Terms
3.1 One-Time Payment: The Software is sold for a one-time payment of ₹20,000. There are no recurring fees, monthly subscriptions, or hidden costs.
3.2 Payment Method: Payment is typically processed via bank transfer, UPI, or as agreed upon during the purchase process.
3.3 Delivery: Upon confirmation of payment, the source code will be delivered within 24 hours via the agreed method (email, cloud storage, or direct server upload).
4. Support and Updates
4.1 Installation Support: We provide complete installation and setup support to get your LMS running on your server.
4.2 Technical Support: Ongoing technical support is provided via WhatsApp (+91 98118 96425) and email (harishchandtiwari@gmail.com) during business hours (Monday-Saturday, 9 AM - 8 PM IST).
4.3 Lifetime Updates: You receive free lifetime updates to the Software, including bug fixes, security patches, and new features.
4.4 Support Limitations: Support does not include custom feature development, extensive customization, or troubleshooting issues caused by third-party modifications.
5. Refund Policy - IMPORTANT
NO REFUNDS AFTER DELIVERING SOURCE CODE
Once the source code has been delivered to you, NO REFUNDS will be issued under any circumstances.This is because you will have received the complete intellectual property and can make unlimited copies.

6. Intellectual Property
6.1 Ownership: We retain all rights, title, and interest in and to the original Software, including all intellectual property rights.
6.2 Your Modifications: You own any modifications or derivative works you create based on the Software, but you cannot redistribute or sell the original Software or your modified versions.
6.3 Copyright Notices: You must retain all copyright and proprietary notices in the source code.
7. Warranty Disclaimer
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.
While we strive to provide a high-quality, bug-free product, we make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that:
- The Software will meet your specific requirements
- The Software will be uninterrupted, timely, secure, or error-free
- Any errors will be corrected immediately
8. Limitation of Liability
To the maximum extent permitted by law, AdvanceLMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or data
- Cost of substitute services
- Business interruption
- Any damages arising from your use or inability to use the Software
In no event shall our total liability exceed the amount paid by you for the Software (₹20,000).
9. Your Responsibilities
You are responsible for:
- Providing appropriate server infrastructure to run the Software
- Securing your server, database, and all data entered into the system
- Complying with all applicable laws regarding data privacy and student information
- Obtaining necessary consents for storing student and teacher data
- Making regular backups of your data
- Not using the Software for any illegal or unauthorized purposes
10. Termination
10.1 Your Right to Terminate: You may stop using the Software at any time. However, no refund will be provided.
10.2 Our Right to Terminate: We may terminate your license if you breach these Terms. Upon termination, you must:
- Cease all use of the Software
- Delete all copies of the source code in your possession
10.3 Survival: Sections regarding intellectual property, warranty disclaimers, and limitations of liability survive termination.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the Software after changes constitutes acceptance of the modified Terms. Terms applicable at the time of your purchase will govern your initial license.
